TERMS AND CONDITIONS

These Terms and Conditions govern access to, browsing of, use of and the purchase of products through the website owned by HYDRO SHIELD S.L. (hereinafter, “the Company”).

Use of this website and the placing of any order imply the user’s full and unreserved acceptance of these Terms and Conditions.

2. PURPOSE

These Terms and Conditions govern the online sale of the products marketed by HYDRO SHIELD S.L. through its website, as well as the rights and obligations of the parties arising from that sale.

3. USE OF THE WEBSITE

The user undertakes to use the website, its content and its services in accordance with the law, good faith, public order and these Terms and Conditions.

The following is prohibited:

●       Placing false or fraudulent orders.

●       Introducing viruses, malware or any other technologically harmful element.

●       Using the website in a way that may damage, disable, overload or impair its operation.

●       Using the content for unlawful purposes or in ways harmful to the Company or to third parties.

The Company reserves the right to deny access to the website or to cancel accounts or orders where it detects improper use or use contrary to these Terms and Conditions.

4. CAPACITY TO PURCHASE

Only persons of legal age with sufficient legal capacity to contract may make purchases through the website.

By placing an order, the user declares that they meet these requirements and that the details provided are truthful, complete and up to date.

5. PRODUCTS

Through its online shop, the Company sells the products described on each product page.

Photographs, videos, descriptions, measurements, colours, finishes and other visual or descriptive elements are provided for information and guidance. Although the Company aims to make that content as true to life as possible, there may be slight variations arising from the user’s screen settings, the manufacturing process, the material or other reasonable circumstances.

The Company reserves the right to modify, replace, update or withdraw products at any time.

6. PRODUCT AVAILABILITY

All orders are subject to stock availability.

If, once the order has been placed, the product is wholly or partly unavailable, the Company will inform the customer as soon as possible and may:

●       offer an alternative solution, where appropriate; or

●       cancel the order in whole or in part and refund the amounts paid for the unavailable product.

7. PURCHASE PROCESS

To place an order, the user must follow the purchase procedure provided on the website and supply the information requested.

The purchase process generally includes:

●       selection of the product or products;

●       review of the cart;

●       entry of shipping and billing details;

●       selection of the shipping method, where applicable;

●       selection of the payment method;

●       express acceptance of these Terms and Conditions and of the applicable legal policies;

●       final confirmation of the order.

Once the purchase process is complete, the user will receive an order confirmation by email. Receipt of that email does not necessarily imply final acceptance of the order in the event of an obvious error, fraud, a payment incident, lack of stock or any other justified circumstance.

8. ORDERS

The Company may reject or cancel an order, even after receiving it, in the following cases, among others:

●       incomplete or incorrect details;

●       inability to verify the transaction;

●       a payment incident or rejection;

●       suspected fraud or bad faith;

●       an obvious error in the price or in the product description;

●       lack of availability.

In such cases, the Company will inform the user and, where appropriate, will refund the amounts actually paid.

9. PRICES

All prices shown on the website are expressed in euros (€) and include any legally applicable indirect taxes, unless expressly stated otherwise.

Shipping costs, additional charges, applicable promotions or any other item to be added to the product price will be shown to the user before the purchase process is completed.

The Company reserves the right to change prices at any time. However, products will be invoiced at the price in force at the time the order is confirmed, except in the case of an obvious error.

In the event of a typographical, technical or human error in the published price, the Company may cancel the order and inform the user before dispatch.

10. PAYMENT METHODS

The user may pay for their orders using the payment methods available on the website at any given time.

The user warrants that they are authorised to use the payment method selected.

If the issuing institution or the payment provider rejects the transaction, the order will not be processed or may be cancelled.

The Company will not directly store the user’s full payment details where the payment is handled through third-party payment platforms.

 

 

11. INVOICING

The customer may request an invoice for their purchase by writing to contabilidad@corkprotech.com, stating the necessary tax details and the order reference, unless the purchase system allows it to be issued automatically.

The user warrants that the details provided for invoicing purposes are correct and complete.

12. DISCOUNTS, VOUCHERS AND PROMOTIONS

Offers, campaigns, vouchers and discount codes are valid only for the period indicated and in accordance with the specific conditions of each promotion.

Unless expressly stated otherwise, they:

●       cannot be combined with one another;

●       cannot be exchanged for cash;

●       are not transferable;

●       cannot be applied retroactively to orders already placed.

The Company reserves the right to cancel promotions in the event of fraudulent or abusive use or use contrary to their conditions.

13. SHIPPING AND DELIVERY

The Company ships within the territories indicated on the website at any given time.

Current shipping area: The destinations, delivery times and shipping costs in force are set out in the Shipping Policy. Because of customs restrictions, shipping to certain countries may be suspended, either temporarily or permanently.

The delivery times shown on the website are indicative and may be affected by logistical circumstances, stock availability, order volume, carrier incidents, force majeure or any other circumstance beyond the Company’s reasonable control.

A reasonable delay for reasons not directly attributable to the Company shall not be considered a breach.

It is the customer’s responsibility to provide a correct and complete delivery address. In the event of an error in the address, repeated absence from the address, unjustified refusal of the delivery or failure to cooperate in receiving the order, the Company may pass on the additional costs actually incurred for re-dispatch, storage or redelivery.

No shipments will be made to PO boxes unless expressly stated otherwise.

14. TRANSFER OF RISK

The risk of loss of or damage to the product passes to the customer at the moment when the customer, or a third party indicated by them other than the carrier, takes physical possession of the product.

If the customer expressly chooses a carrier other than the one proposed by the Company, the risk passes at the moment the product is handed over to that carrier, without prejudice to the rights to which they may be legally entitled as a consumer.

15. RIGHT OF WITHDRAWAL

Where the buyer is a consumer or user, they may exercise their right of withdrawal on the terms legally applicable to distance contracts. Spanish legislation generally provides for a minimum period of fourteen calendar days for withdrawal in contracts with consumers.

To exercise this right, the customer must communicate their decision unequivocally via legal@corkprotech.com, stating at least:

●       full name;

●       order number;

●       the product or products concerned;

●       the date the order was received;

●       an express wish to withdraw.

The product must be returned in appropriate condition, properly protected and, wherever possible, in its original packaging and with all its accessories.

The cost of returning the goods on withdrawal is borne by the customer.

The right of withdrawal does not apply in the cases excluded by the applicable legislation, including, where relevant, personalised products, products made to the customer’s specifications, products unsealed for reasons of hygiene or health where they cannot be returned, or any others legally excluded.

16. RETURNS FOR FAULTY, DAMAGED OR INCORRECT PRODUCTS

If the customer receives a product that is faulty, damaged in transit, incorrect or not as ordered, they must notify the Company as soon as possible at soporte@corkprotech.com, attaching, where possible, photographs and a description of the problem.

Once the claim has been reviewed, the Company may offer, as appropriate and in accordance with the applicable legislation:

●       replacement of the product;

●       repair;

●       substitution;

●       a price reduction; or

●       termination of the contract with a refund.

The Company may ask the customer to return the product concerned before finally resolving the matter.

17. LEGAL GUARANTEE

Products sold to consumers and users carry the legal guarantee of conformity applicable at any given time under the legislation in force.

The guarantee does not cover damage arising from:

●       improper or negligent use or use contrary to the instructions;

●       knocks, drops or accidents;

●       normal wear and tear;

●       improper handling;

●       repairs or alterations carried out by unauthorised third parties;

●       external causes unrelated to the product.

To process any guarantee claim, the customer must keep the proof of purchase and contact the Company at soporte@corkprotech.com.

18. PROPER USE OF THE PRODUCT

The customer undertakes to use the products in accordance with their intended purpose, the instructions for use, the safety warnings, the technical limitations and the recommendations of the manufacturer or of the Company.

The Company shall not be liable for damage arising from incorrect, careless, unauthorised use or use contrary to the instructions provided.

The product sold is designed to hold a specific model of mobile handset fitted with all its original components. When putting the phone into the case it is important not to bend the case or twist any of its edges and/or tabs, taking care and being gentle when inserting and removing the phone, bearing in mind that this is a case made from natural materials.

When the case comes into contact with water with the phone inside, once the case has been recovered from the water you must remove the phone with great care, because the natural cork material is damp and you could otherwise break or crack one of the tabs.

Check for cracks or splits in your case before it comes into contact with water. We recommend making sure every month, in a safe place where you can recover your mobile device, that the case still floats.

If your mobile device gets wet, follow the manufacturer’s recommendations.

The company accepts no liability for damage caused to the phone through a lack of maintenance of the phone, or through use of the case contrary to these instructions.

Use the case only for the phone model it is made for. Do not use the case with phone models other than the one it was designed for, since in those cases the Company does not guarantee the buoyancy of the product.

 

19. LIABILITY

The Company shall not be liable for:

●       interruptions, technical errors or temporary unavailability of the website;

●       damage arising from improper use of the website by the user;

●       indirect damage, loss of profit or loss of business opportunities, except where the law provides otherwise;

●       delays or failures due to causes beyond its reasonable control.

Nothing in these Terms and Conditions limits the rights to which consumers and users are legally entitled, nor excludes liability in cases where it is not legally possible to do so.

20. INTELLECTUAL AND INDUSTRIAL PROPERTY

All the content of the website, including texts, images, designs, photographs, trade marks, trade names, logos, structure, source code and other elements, belongs to HYDRO SHIELD S.L. or to third parties who have authorised its use.

Its reproduction, distribution, transformation, public communication or any other form of exploitation without the prior written authorisation of the relevant owner is prohibited.

21. DATA PROTECTION

The personal data provided by users will be processed in accordance with the website’s Privacy Policy.

22. COOKIES

The website may use its own and third-party cookies. The user can find detailed information in the corresponding Cookie Policy.

23. FORCE MAJEURE

The Company shall not be liable for delays, failures or inability to perform where these arise from force majeure or circumstances beyond its reasonable control, including, by way of example, strikes, labour disputes, supply failures, transport interruptions, fires, floods, natural disasters, administrative restrictions, pandemics, cyberattacks or serious incidents affecting third-party suppliers.

For as long as the force majeure event lasts, the obligations affected shall be suspended for the time strictly necessary.

24. AMENDMENT OF THE TERMS AND CONDITIONS

The Company may amend these Terms and Conditions at any time in order to adapt them to legal, technical, operational or commercial changes.

In any event, the conditions in force at the time the order is placed shall apply to that order.

 

 

25. PARTIAL INVALIDITY

If any clause of these Terms and Conditions is declared null, invalid or unenforceable, this shall not affect the validity of the remaining clauses, which shall remain fully in force.

26. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by Spanish law.

In the event of a dispute, where the buyer is a consumer or user, the courts and tribunals determined by the applicable legislation shall have jurisdiction.

Where the relationship is between businesses or professionals and the legislation so permits, both parties expressly submit to the Courts and Tribunals of Valencia, waiving any other jurisdiction to which they may be entitled.
